Thanks to John C Julian ( or julian john ) who reminded me i needed the -n option to ssh otherwise it replaces the current process with itself. I used to have this option so under this portion of the script testing it worked, but i then removed it due to the -n option NOT working when using rsync. I had a variable called SSH_OPTS see which when passed to the connection test bit is ok with the -n and works, but if passed to rsync it fails. I have amended script to only have -n on the connection test now and all is working fantastically.
